Ownership of a house in Thailand can be transferred separately from the land on which it stands. Land and house may have different owners and with a long-term lease it is strongly recommended to follow the correct procedure to obtain legal ownership of the house. The transfer of a structure detached from the property must be in writing and registered with the appropriate authority (i.e., branch of the Land Department or provincial office). The right to possess a building on another’s land always relates to the term of a right to use and possess the land (i.e. the term of the lease and/or the term of the building right).
